Terms & Conditions
These terms and conditions ("Terms") govern your use of the Lucinda Button Textiles website (the "Site") and the purchase of any art prints, original artworks, or commissioned pieces ("Products") from us. Please read these Terms carefully before placing an order. By placing an order through the Site you confirm that you have read, understood, and agree to be bound by these Terms.
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable UK consumer protection law.
1. About Us
The Site is owned and operated by Lucinda Button, trading as Lucinda Button Textiles ("we", "us", "our"). We are an independent artist and maker based in the United Kingdom.
If you need to contact us about your order or these Terms, please email us using the contact details listed on the Site. We aim to respond to all enquiries within three (3) working days.
2. Definitions
"Commission" means a bespoke or made-to-order Product produced to your specification.
"Contract" means the legally binding agreement between you and us for the sale and purchase of a Product, formed in accordance with clause 3.
"Order" means the request you submit through the Site to purchase one or more Products.
"Original Artwork" means a one-of-a-kind piece of art produced by hand and sold as a unique item.
"Print" means an open or limited edition reproduction of an original artwork, produced on paper.
3. Placing an Order
All Orders placed through the Site are an offer by you to purchase a Product subject to these Terms. We are not obliged to accept your Order, and we may refuse or cancel any Order at our discretion (for example, where a Product is out of stock, where there has been a pricing or description error, or where we are unable to obtain payment).
A Contract is formed only when we send you an email confirming that your Order has been accepted and is being processed. An automated acknowledgement of your Order is not an acceptance.
You are responsible for ensuring that the details you provide at checkout, including your delivery address and contact information, are accurate and complete. We are not liable for delays or failures in delivery caused by incorrect information you have supplied.
4. Products and Descriptions
We take care to describe and photograph our Products accurately. However, because Original Artworks and Prints are hand-finished or hand-produced, slight variations in colour, texture, paper finish, and dimensions are normal and to be expected, and do not constitute a defect.
Colours displayed on the Site may also vary slightly depending on your screen settings. We cannot guarantee that the colours shown on your device will exactly match the finished Product.
Dimensions given for Products are approximate and refer to the unframed image or paper size unless otherwise stated. Frames, mounts, and props shown in photographs are for display purposes only and are not included unless expressly listed.
5. Price and Payment
All prices are shown in pounds sterling (GBP) and are inclusive of VAT where applicable. Delivery charges are additional and are calculated and displayed at checkout before you place your Order.
We reserve the right to change the price of any Product at any time before we accept your Order. If a pricing error is discovered after we have accepted your Order, we will contact you and give you the option to confirm the Order at the correct price or cancel it for a full refund.
Payment is taken in full at the time of Order. We accept the payment methods displayed at checkout. By submitting payment details, you confirm that you are authorised to use the payment method provided.
6. Delivery
We currently ship to addresses within the United Kingdom only. We do not accept international Orders through the Site at this time.
Estimated dispatch times for in-stock Prints are stated on the relevant product page and are usually three to five (3-5) working days from Order acceptance. Original Artworks and Commissions have longer lead times, which will be confirmed in writing before the Contract is formed.
Delivery times quoted are estimates only and are not guaranteed. We are not liable for delays caused by our carriers, postal services, or any other event outside our reasonable control.
Risk in the Product passes to you on delivery to the address specified in your Order. Ownership of the Product passes to you only once we have received payment in full.
7. Cancellation, Returns and Refunds
7.1 Your right to cancel (non-bespoke Products)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a Contract for the purchase of a standard, non-bespoke Product (such as an open edition Print) within fourteen (14) days of the day you, or someone you nominated, received the Product.
To exercise your right to cancel, you must inform us in writing (by email) before the end of the 14-day period, clearly stating your decision to cancel. You must then return the Product to us, unused and in its original condition and packaging, within fourteen (14) days of telling us you wish to cancel.
You are responsible for the cost of returning the Product to us, and for ensuring it is adequately packaged and insured for the return journey. We recommend using a tracked service, as we cannot refund Products that are damaged or lost in return transit.
Once we have received the Product and confirmed it is in a resaleable condition, we will refund the price you paid for it, together with the standard delivery cost paid (if any), within fourteen (14) days. We may reduce the refund to reflect any reduction in the value of the Product caused by your handling of it beyond what is necessary to establish its nature, characteristics, and functioning.
7.2 Exceptions — Commissions and personalised Products
In accordance with regulation 28(1)(b) of the Consumer Contracts Regulations 2013, the right to cancel under clause 7.1 does NOT apply to Commissions or any Product that has been made to your specification or clearly personalised. By placing an Order for a Commission, you acknowledge and accept that you waive the statutory 14-day cooling-off period.
Specific cancellation terms for Commissions are set out in clause 9 below.
7.3 Original Artworks
Original Artworks are eligible for the standard 14-day right to cancel under clause 7.1, provided they are returned unused, undamaged, and in their original packaging. Because Original Artworks are unique, we strongly recommend returning them via a fully tracked and insured service.
7.4 Faulty, damaged, or incorrect Products
We take great care in packaging our Products, but occasionally damage can occur in transit. If your Product arrives damaged, faulty, or is not what you ordered, please contact us within seven (7) days of delivery, providing photographs of the Product and its packaging.
Under the Consumer Rights Act 2015, you have the right to a full refund, replacement, or repair (where appropriate) for any Product that is not of satisfactory quality, fit for purpose, or as described. This right is in addition to, and does not affect, your right to cancel under clause 7.1.
Where we agree to replace or refund a damaged or faulty Product, we will also reimburse reasonable return postage costs.
8. Limited Edition Prints
Where a Print is sold as a limited edition, the edition size will be clearly stated on the relevant product page. Limited edition Prints are signed and numbered by the artist. Once an edition is sold out, no further copies of that edition will be produced at the same size and on the same paper stock.
We reserve the right to produce artist proofs ("APs"), typically up to 10% of the stated edition size, which are not counted within the numbered edition.
9. Commissions
Commissions are subject to a separate written agreement which will be confirmed by email before any work begins. The agreement will set out the brief, dimensions, materials, price, deposit, payment schedule, and estimated completion date.
A non-refundable deposit of fifty per cent (50%) of the agreed price is payable at the time of booking, with the balance payable before the finished Commission is dispatched. The deposit covers materials, design time, and the reservation of studio time, and is not refundable if you choose to cancel the Commission once work has begun.
We will share progress images at reasonable intervals during a Commission. You may request minor adjustments at the agreed review stages, but you may not require us to substantially alter the agreed brief once work has begun without our written consent and, where appropriate, payment of additional fees.
If, on receipt of the finished Commission, you consider it does not meet the agreed brief, you must contact us within seven (7) days of delivery. We will work with you in good faith to resolve the matter; however, subjective preference (for example, you no longer like the colours you originally agreed) is not grounds for refund.
10. Intellectual Property and Copyright
All artwork, designs, images, text, and other content on the Site, and in or on any Product, are the intellectual property of Lucinda Button and are protected by copyright law. All rights are reserved.
Purchase of a Product gives you ownership of the physical item only. It does NOT transfer any copyright, reproduction rights, or other intellectual property rights in the underlying artwork. In particular, and without our prior written consent, you may not:
reproduce, copy, scan, photograph for commercial use, or digitise any Product;
use any Product or its imagery for commercial, promotional, or merchandising purposes;
create derivative works based on any Product; or
sell, license, or distribute reproductions of any Product.
You may photograph Products you have purchased for personal, non-commercial use (for example, sharing on personal social media), provided you credit Lucinda Button Textiles where reasonably possible.
We retain the right to reproduce, photograph, and use images of all Products (including Commissions and Original Artworks) for our own portfolio, marketing, and promotional purposes, unless otherwise agreed in writing.
11. Our Liability
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be limited or excluded.
Subject to the above, our total liability to you in connection with any Contract (whether in contract, tort, breach of statutory duty, or otherwise) is limited to the total price paid by you for the relevant Products.
We are not liable for any indirect, consequential, or special loss, or for any loss of profit, business, goodwill, or anticipated savings, arising from or in connection with these Terms. This clause does not affect your statutory rights as a consumer.
12. Privacy and Data Protection
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Information about what data we collect, how we use it, and your rights is set out in our separate Privacy Policy, which is available on the Site.
By placing an Order, you consent to us processing your personal data for the purposes of fulfilling your Order, providing customer service, and complying with our legal obligations.
13. Events Outside Our Control
We are not liable for any failure to perform, or delay in performing, our obligations under a Contract where that failure or delay is caused by events outside our reasonable control, including but not limited to acts of God, fire, flood, severe weather, industrial action, pandemic, civil unrest, or failure of postal or courier services. In such cases, we will contact you to agree a revised delivery date or, if appropriate, cancel the Order and refund any sums paid.
14. Complaints
We aim to provide a high standard of service. If you are unhappy with any aspect of your Order or our service, please contact us by email so that we can try to resolve the matter promptly. We will acknowledge your complaint within five (5) working days and aim to provide a substantive response within twenty (20) working days.
If we are unable to resolve your complaint to your satisfaction, you may also have the right to refer the matter to an Alternative Dispute Resolution provider or, where applicable, to your local Trading Standards office.
15. Changes to These Terms
We may update these Terms from time to time, for example to reflect changes in the law or in our business practices. The version that applies to your Order is the version published on the Site at the time you place your Order. We recommend that you save or print a copy of these Terms for your records.
16. Governing Law and Jurisdiction
These Terms, and any Contract formed under them, are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or any Contract is subject to the non-exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
17. General
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
These Terms constitute the entire agreement between you and us in relation to the subject matter of any Contract, and supersede any prior agreements or representations.
